Florida mothers may relate to one woman’s devastation when her child was born with severe brain injuries. To make matters worse, those injuries were entirely preventable and were caused by a doctor’s negligence during birth. Medical malpractice is a serious issue that continues to plague our society. When errors are avoidable, it is understandable that patients want justice for the damage that has been sustained.
The mother whose baby was injured during birth was awarded $250,000 in U.S. District Court for emotional pain and suffering. What should have been a time of joy and excitement turned into a horrific tragedy when a doctor chose to ignore signs that the woman’s baby was showing signs of distress during labor. A federal judge determined that the doctor waited too long to perform a needed c-section, which resulted in serious brain injury to the child that could have been prevented.
The child was awarded $9.6 million. She is now a 3-year-old who can do nothing for herself. The professional medical prognosis is that she will never walk or talk and will always need to be fed through a stomach tube. She also suffers from seizures.
