Experienced Property Insurance Attorneys Dedicated To Protecting Property Owners In South Florida
Panter, Panter & Sampedro
Panter, Panter & Sampedro represents Florida homeowners and commercial property owners in residential and commercial property insurance claims. The firm handles denied, delayed, and underpaid claims involving hurricane, wind, water, fire, roof, mold, theft, and structural damage.
Property owners expect their insurance carrier to provide the coverage they have paid for. In practice, many insurance companies do not pay fair value on a claim, especially on a large, high-dollar property loss. Recovering the full amount of a claim often requires legal action to hold the insurance carrier to the terms of the policy.
Panter, Panter & Sampedro has represented Florida property owners for more than 30 years. The firm guides each client through the claims process, explains the client’s rights under the policy, and works to protect the client’s interests at every step.
Panter, Panter & Sampedro represents residential and commercial property owners in many types of insurance claims, including flood, wind, fire, storm damage, theft, and structural damage. The firm works to recover the benefits each policyholder is owed, which can include repairing or replacing damaged property and covering living expenses or loss of use while repairs are underway.
How Long do Property Owners Have to File a Florida Property Insurance Claim?
The time property owners have to file a Florida property insurance claim depends on the type of claim, and a missed deadline can bar recovery. Florida law sets separate deadlines for notifying the insurer and for filing a lawsuit.
- Initial or reopened claim: A property owner generally must give the insurer notice of a claim within one year after the date of loss, under Fla. Stat. §627.70132.
- Supplemental claim: A property owner generally must give notice of a supplemental claim within 18 months after the date of loss, under Fla. Stat. §627.70132.
- Lawsuit against the insurer: Florida sets a separate, shorter deadline to file suit for breach of a property insurance policy, and recent legislation reduced that period. Because the trigger date and length depend on the policy and the facts, a property owner should confirm the lawsuit deadline with an attorney.
Property owners should report damage to the insurer as soon as possible and keep records of the loss, because delay can reduce or bar a recovery. Deadlines change based on the facts of each claim, so property owners should speak with a property insurance attorney soon after a loss.
