David Sampedro reached a confidential settlement and resolved the injuries of two of his clients as a result of the negligence of a commercial driver for over $1 million. Jose Alonso, a 65-year-old gentleman was injured when he was rear-ended by a tractor-trailer while he was at a complete stop on the Florida Turnpike as a result of another unrelated accident further up the road. Unfortunately, the tractor-trailer driver who was behind him failed to pay close attention and did not stop his heavy load from colliding into the rear of Mr. Alonso’s vehicle.
Mr. Alonso did not lose consciousness and refused to go to a hospital. Approximately one week after his motor vehicle accident, he visited an orthopedic surgeon because of neck pain. After having some unsuccessful facet injections, Mr. Alonso was recommended for a cervical discectomy and fusion at two different levels in his neck. Mr. Alonso was unable to work for a significant amount of time and incurred medical bills because of the injuries he sustained in this commercial motor vehicle accident. Otherwise, Mr. Alonso, fortunately, had a somewhat uneventful recovery.
Heather Stonewall complained of pain in her right foot, knee, and hip. Fire rescue came to the scene of the accident and transported her to a local hospital where it was determined that she had sustained a tibial plateau fracture. Her orthopedic surgeon performed an open reduction, and internal fixation to treat her fracture. Thereafter, she underwent physical therapy for approximately eight weeks. Following her accident, Ms. Stonewall was forced to work from home and was later confined to a wheelchair until she was able to apply some weight on her foot as usual by using a walker.
After filing a complaint and engaging in discovery, opposing counsel approached David about an early mediation. The matter was resolved for just over $1 Million Dollars.
