In these unprecedented times, we are all looking for ways to adopt to normalcy as best as we can. As attorneys with over 30 years of experience, this has certainly brought on new challenges, but it also has brought us closer together. We have always worked together as a team, but there is new meaning to that as our efforts spread far beyond our office walls, our homes, and even our local community. We are closely following updates from our local government in hopes that we can do our part to help flatten the curve. However, we also have another job to do and that is to continue our mission to protect Florida’s families.
Personal injury cases, including car and auto accidents in Miami and throughout Florida are still being accepted and the cases are still being worked on, but in new ways. Here is what you need to know:
Existing Personal Injury Cases
On Monday, April 6, 2020, Florida Supreme Court Chief Justice Charles T. Canady issued an issued Administrative Order (AOSC20-23) to extend the suspension of non-essential and non-critical court appearances and jury trials through Friday, May 29, 2020. What this means is that personal injury cases will not progress with in-person court dates at this time. However, some court proceedings are still able to take place through telephone or remote technology. This may include mediation and other court proceedings.
Outside of court appearances, if you have an active personal injury litigation case, there may be other actions that can be taken in order to move your case forward. For example, we are still actively speaking with opposing counsel and insurance adjusters. If your case is a pre-litigation case—meaning that we are attempting to resolve the matter without a lawsuit—we are still working through the protocol as best as we can by continuing to call insurance companies, medical providers, and providing you with updates. We are also participating in virtual mediations when possible.
New Personal Injury Cases
Even though the courts are closed for in-person appearances and jury trials, we are still able to file new personal injury cases. We are open in a limited capacity; however, we are able to file claims and speak with you through remote and virtual technologies. For example, even though we are unable to meet with you in person to discuss the details of your injury, we are able to communicate with you through video conference programs. We are also able to begin the process of communicating with doctors, medical personnel, insurance providers, etc.
If you are involved in an accident, please make sure that you obtain pertinent information such as photographs, witness contact information, etc. as we will still need this information. If you need non-emergency medical care or treatment, there are facilities that we work with that are still able to provide care and treatment to you.
