Accidents are common at construction sites throughout the country. A Florida man has been seriously injured after falling while working at an apartment complex.
The construction accident happened on the morning of Jan. 7 in Destin. The 33-year-old man was working on the balcony of the luxury apartment complex, when he suddenly fell four stories. It is unknown what caused him to fall.
The fall caused the man to receive multiple injuries. He was airlifted to a hospital in Pensacola for treatment. The man is an employee for Davis Development, a company based in Georgia. The accident is currently under investigation by the Occupational Safety and Health Administration.
The man is lucky to be alive after a fall from such a height. However, he did become seriously injured and will likely face challenges as he struggles to recover. As his medical bills pile up, he should be somewhat comforted knowing that he has the legal right or receive workers’ compensation benefits. These benefits are available to him whether or not the fall was his fault. Workers’ compensation benefits are nominal amounts of money, but they are a blessing to those who are unable to work due to a workplace injury.
The investigation by OSHA will help determine who caused the fall. Was it simply an accident caused by the employee? Did employer negligence have something to do with it? If the company failed to properly train the employee or provide him with proper safety equipment, then it could be held liable. This means that the man may be able to file a civil claim against his employer for his injuries, lost wages and emotional damages caused by the accident.
