Signs of medical malpractice in birth injuries

For most parents, a child born with a serious injury, illness, disease or complication is a traumatic event. A bigger problem comes up for many parents in this situation when they start considering a legal action.

Since many birth injuries are a result of accidents, chance or illness outside of human control, how do you know whether or not your child’s injuries were caused by your doctor’s negligence?

Without talking to an experienced medical malpractice attorney, there is no way of knowing whether your doctor was at fault for your child’s injuries, but there are some signs to look for:

  • Bruising, bone fractures and other physical injuries: If you see these signs in your child immediately after birth, they could be signs of excessive force during birth, especially when found after the doctor used forceps or vacuum technology during the birthing process.
  • Lethargy: Most kids make a lot of noise and move a lot after the traumatic experience of birth. When they are quiet or unusually still, it could be a sign of some kind of serious birth injury caused by negligence.
  • Coloration: If your child has some strange colors, like bluish or yellowish, immediately after birth, it could be a result of error from your doctor.

The most important thing to pay attention to is when your child began exhibiting these symptoms. If your child shows unusual or alarming symptoms right away after birth, the cause is more likely to be found in the birthing procedure itself. Conversely, if these symptoms show up days or weeks after birth, it is more likely not your doctor’s fault.
