A slip-and-fall accident can happen to any Florida resident at any time and in any place. It doesn’t even have to involve a puddle of water or other liquid. Sometimes a person can slip on loose debris, causing serious injuries. One woman is suing J.C. Penney after she fell inside the retail store during a recent shopping trip.
The woman filed a premises liability claim against J.C. Penney Corp. Inc., on Jan. 6. The woman was shopping at the store in a Texas shopping mall on Nov. 22, when she allegedly slipped on some debris that was on the floor. The debris caused her to fall and suffer injuries.
The woman claims that J.C. Penney failed to maintain the premises and make it safe for customers. She is also suing because she was not made aware of the dangerous property condition. It is unknown how much the woman is seeking in damages.
A business owner has a duty to keep customers safe while they are on the business’ property. A floor that has puddles or debris can pose a serious risk to customers. The owner can be considered negligent and held liable for any injuries suffered by the victim in the event of slip and fall.
The extent of the woman’s injuries is unknown, but she could suffer from broken bones and head injuries. These injuries are serious and could take a long time to heal properly. They may persist for years, resulting in tens of thousands of dollars in medical expenses. If the woman prevails in the lawsuit, she could receive compensation to pay for these damages.
